Case of documents

Very interesting case indeed. I also read the article from die Welt (linked in the JW article: For more information, please see this link to a Die Welt article entitled “BGH Examines Dispute Over Family Archive of Persecuted Jehovah’s Witnesses.”) and this part seems to be really unfair:

Acquired in good faith?

The legal dispute before the Federal Court of Justice is now mainly about the question of whether the Federal Republic of Germany has acquired the Kusserov archive “in good faith”. In this case, the buyer of an object is the rightful owner even if the item did not belong beforehand to the one from which he bought it. The prerequisite for this purchase “in good faith” is that the buyer did not know or could know that the item did not belong to the seller.

Also, according to the Civil Code, the object must not have been “stolen, lost or otherwise lost”. The Federal Court of Justice should also clarify when a “lost” object is no longer considered such. The Higher Regional Court (OLG) Cologne had ruled that the Jehovah's Witnesses had tolerated the Kusserov brother as the owner of the archive and thus legitimized him. The plaintiffs’ side thinks that subsequent legitimacy is not possible.

 

 

If I understand it correctly we now have to prove that the Bundeswehr Military History Museum in Dresden didn't buy the archive “in good faith” 🤯 How ridiculous is this? And what's the point of museum's refusal and legal fight if they display less than 6% of the whole archive?

I hope Jehovah will help our brothers to win this case and we'll have a chance to see those precious artefacts without providing financial support for German Army 🙄
