"Historic Trial for the People of Jehovah in Brazil"

I watched the trial live yesterday, with 5 favorable votes, and I was very moved. :cry:

 

It was an excellent testimony from the highest authorities in the country, all 5 speaking in favor of alternative treatments, PBM (Patient Blood Management) and the Directives card.

 

One of them said he was amazed by the superior quality of bloodless treatments and another said that this trial will end the prejudice that exists about this treatment (it is not a treatment of inferior quality).

The case is won, there is just one vote left for the majority, and there are only six votes left, so it is clear that the case has already been won, what is important now is the thesis, that is, what will be made explicit by the court, which although is not in Judgment on minors, the court will make some pertinent observations, one proposal is that if there is a viable medical alternative, the wishes of the parents will be respected, and if there is an imminent risk of death, without adequate time to seek such an alternative, the medical opinion or judicial decision, but the trial itself will only involve those over 18 years of age and capable of making a decision, but the ministers found it opportune to make some things clear even outside this restricted context, which until now, within constitutional public law Brazilian, seems to be the most balanced and even in the issue of minors, it is not an embrace of full contemplation of paternal authority, it is a great advance that will provide greater legal security and reduce fears, and obviously this issue of minors may reach the court later on .

Today at 2:00 PM (Brazil time), the trial resumes regarding our right to access bloodless treatment funded by the state through the Unified Health System (SUS), as well as the right to refuse a blood transfusion. Last Thursday, 5 votes were in favor. So, only one more vote is needed to form a majority. There are 6 judges left to vote. Therefore, there is a strong chance that this trial will be concluded today or tomorrow. Although it looks quite favorable, let us continue praying that Jehovah guides this matter in the best way.

Now decided by the STF (Brazilian Supreme Federal Court): 

 

In RE 979742, the extraordinary appeal was unanimously denied, and the thesis proposed by the president of the Supreme Federal Court, Luis Roberto Barroso, was approved. And in RE 1212272, the extraordinary appeal was deemed to be without merit, and the thesis proposed by Minister Gilmar Mendes was approved. 

 

In conclusion, Jehovah’s Witnesses in Brazil have the right to refuse medical treatment involving blood transfusions, especially when alternative treatments are available. And, more than that, they have the right to travel to a Unified Health System unit in another location, if this is not possible in the city where they are domiciled.

He was a hemophiliac and he passed away as a victim of AIDS due to a contaminated blood transfusion. Interestingly, Betinho also had two brothers, Henfil and Chico Mário, and both also died of AIDS for the same reason, contaminated blood transfusion."
