Trump considering a move to invoke Insurrection Act

WASHINGTON — President Donald Trump could announce as early as Monday night that he’s invoking a 213-year-old federal law that would allow him to deploy active-duty U.S. troops to respond to protests in cities across the country, according to four people familiar with the decision.

 

The military police forces would come from Fort Bragg in North Carolina and possibly Fort Belvoir in Virginia and could arrive in Washington within hours, these people said.

The Insurrection Act has been invoked infrequently throughout American history, most recently following looting in the aftermath of Hurricane Hugo in 1989 and during the 1992 Los Angeles riots.

The Insurrection Act would allow the military to take up a policing authority it otherwise would not be allowed to do, enforcing state and federal laws,“said Stephen Vladeck, a University of Texas School of Law professor who specializes in constitutional and national security law.

 

The statute “is deliberately vague” when it comes to the instances in which the Insurrection Act could be used, he said. The state’s governor could ask President Donald Trump to take action or Trump could act on his own authority if he’s determined that the local authorities are so overwhelmed that they can’t adequately enforce the law, Vladeck said.

 

“It is a very, very broad grant of authority for the president,” he added..

This has always been the great weakness of the US governmental system: yes, there are checks and balances, but what do you do when one branch of government just has absolute contempt for the others and refuses to yield to them?  I mean, you can impeach the President and remove him from office, but what if he simply refuses to go?

We've only existed as a democracy this long because, to this point, we haven't gotten someone in the White House really willing to push this.  Even Nixon eventually resigned when he got caught.

When we woke up this morning, before the tv was turned on, my husband said, “Wonder if we are under martial law yet”. 
I’m two layers away from all this. 
We live really rural, and, most important, Jehovah will get it straightened out. Swiftly, and wonderfully! 

I want to age without sharp corners, and have an obedient heart!

Impeached simply means brought up on charges.  Trump was impeached.  So was Clinton.  So was Johnson.  None of these men were removed from office because the decision of the impeachment proceedings did not result in the removal of the President.  If Trump's impeachment had resulted in his removal from office, he would have been removed from office.  There is no way he could have stopped it.  Unlike some other rulers, the President does not exercise that type of authority of the police or military.  The reality is, though, that the Senate was never going to remove Trump from office because they majority support him.

 

Nixon resigned to avoid being removed from office.  He resigned before impeachment proceedings could begin.

 

Trump has the authority to call out the troops under the Insurrection Act.  This is the same authority that was used in 1992 to mobilize troops during the Rodney King Riots.  The Insurrection Act was used during the desegregation era as well.

FYI. For the IA to take effect requires the Governor of any given state to request it. Washington DC , not being a State , has as its Governor ...The President.  The US System prevents a President from many actions that people mistake they are capable of unilaterally.

But there may be curbs on what Trump can do. One section of the law suggests that states must first request help, but other portions of the Insurrection Act do not require a governor or state legislature's okay, such as when the President determines the situation in a state makes it impossible to enforce US laws or when citizens' rights are abridged.

 

"Historically and practically, such a request is not necessarily a prerequisite to the President using regular federal troops for domestic law enforcement," said Stephen Vladeck, a University of Texas law professor and CNN contributor.

It’s funny watching many of governors and Mayors. They are so afraid of offending people and being politically correct, they allow innocent citizens to suffer.  :facepalmpo2:
Sure makes the choice between mans rulers and God’s Kingdom very easy.
